11) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JEN HUGHES HERNANDEZ AND HER OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, SERVICES, OR MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13) Governing Law; Venue (Texas)

These Terms and any dispute or claim arising out of or related to them are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Harris County, Texas for any legal suit, action, or proceeding arising out of these Terms or your use of the Site or Services.

14) Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease, but the provisions that by their nature should survive (e.g., IP ownership, disclaimers, limitations of liability, indemnity, and governing law) will survive termination.

15) Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which explains how we collect, use, and share information.

16) General

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Jen Hughes Hernandez regarding the Site and Services.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Any failure to enforce any provision is not a waiver of that provision or any other provision.
• Assignment: We may assign these Terms, in whole or in part, at any time. You may not assign any rights or obligations without our prior written consent.
• Headings: Headings are for convenience only and do not affect interpretation.
